Terms of Service

You must be at least 18 years old to create an account. You agree to provide accurate and complete information when you register and to keep your account credentials secure. You are responsible for any activity that occurs under your account.

Eulogia provides AI-assisted tools for generating, editing, and sharing obituaries based on information you supply about a deceased person. The generated text is a starting point intended for your review and editing — you are responsible for verifying its accuracy before use.

Single Obituary purchases. A single obituary purchase grants you 30 days of access to generate and refine one obituary about one decedent. After 30 days, the obituary becomes read-only.

Professional subscriptions. Funeral home and professional subscription plans grant you a monthly or annual allotment of obituaries (1–10 for Tier 1, 11–20 for Tier 2, 21–50 for Tier 3). Each unique decedent counts as one obituary toward your monthly quota. Multi-location providers should contact us for separate terms.

Per-decedent rule. Each obituary purchase or subscription credit is tied to one decedent. Once you generate an obituary, the deceased name is locked and may not be changed without contacting support. Misuse of the per-decedent rule may result in account suspension.

Refunds. Single obituary purchases are non-refundable once the AI generates the obituary text. Subscriptions may be cancelled at any time; you retain access until the end of your current billing period. We do not pro-rate refunds for partial periods.

You retain all ownership rights to the information you provide and the obituaries you generate ("Your Content"). By using the Service, you grant us a limited license to process, store, and deliver Your Content for the purpose of operating the Service.

You are responsible for ensuring you have the right to share the information you provide, including photos and information about family members. Do not upload content you do not have permission to use.

The obituary text produced by the Service is generated by artificial intelligence. While we strive for accuracy, AI output may contain errors, omissions, or inaccuracies. You are solely responsible for reviewing, editing, and verifying the accuracy of generated content before publishing or sharing it. We do not guarantee any particular quality or suitability of generated content.

You agree not to:

• Use the Service to generate obituaries for living persons or fictional individuals (other than for clearly labeled training or testing)
• Share, sell, or distribute generated obituaries as if they were our work product
• Use the Service for any illegal, fraudulent, or harmful purpose
• Attempt to gain unauthorized access to the Service or other accounts
• Use the Service to harass, defame, or harm any person
• Reverse engineer, scrape, or extract data from the Service in bulk
• Circumvent the per-decedent pricing rule by reusing one purchase for multiple decedents

The Service, including its name, logo, design, source code, and underlying technology, is owned by Eulogia and protected by copyright and other intellectual property laws. You may not copy, modify, or reproduce any part of the Service except as expressly permitted.

You may close your account at any time by emailing support@eulogia.app. We may suspend or terminate your account if you violate these Terms or if we are required to do so by law. Upon termination, your access to the Service ends, but provisions of these Terms that by their nature should survive (e.g., ownership, disclaimers, limitations of liability) will continue.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EULOGIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold Eulogia harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Texas.

We may modify these Terms at any time. We will notify you of material changes by email or via the Service. Continued use of the Service after a change constitutes acceptance of the modified Terms.
